The legislative base of Ukraine on preservation of animal life and international conventions

 

      The legislative base of Ukraine is characterized by wide enough возможностями to organize activities aimed at nature preservation, including amphibians. We believe that for this very edition Law of Ukraine "On Preservation of the Environment" (N 1264-ХП of June 25, 1991), "On Animal Life" (N 2894-III of December 13, 2001), "On the Red Book of Ukraine" (N 3055-III of February 7, 2002) and Decree of the Cabinet of Ministers (N 772 of November 15, 1994 "On the Order of Introduction of the Cadastre of Animal Life", N 391 of March 30, 1998 "On Approval of the Regulation on the State System of Monitoring of the Environment" N 1551 of November 17, 2001) have the most important meaning among a large number of regulations.

 

     It should be emphasized that the last (second) edition of the Red Book of Ukraine was carried out back in 1994 (The Red Book of Ukraine / Edited by M. M. Shcherbak. - К.: Ukrainian Encyclopedia, 1994. - Page 464). According to Article 12 of Law of Ukraine about the Red Book of Ukraine, which provides for re-edition of the Red Book of Ukraine no less often than once every 10 years, on June 15, 2004, on the basis of the Zoology Institute named after I. I. Shmalgauzen of the National Academy of Science of Ukraine a conference of curators of individual groups of animals of the National Commission of The Red Book of Ukraine was held. Among other issues considered here a new list of amphibians was proposed to be entered to the Red Book of Ukraine. A part of Article 14 ("Selection of Species of Plant and Animal Life for the Red Book of Ukraine") served as a foundation for compilation of such a list. The Article declares that "In the first place relic and endemic species, species located on the border of the natural habitat, species with a special scientific value, as well as species rapidly decreasing in number as a result of human economic activity are to be entered to the Red Book of Ukraine".

 

The following amphibians of the Ukrainian fauna meet such criteria (the names of animals here are given in Ukrainian and Latin):

A. Amphibians listed in the previous edition of the Red Book of Ukraine (The Red Book of Ukraine /Edited by М. М. Shcherbak. - К. : Ukrainian Encyclopedia, 1994. - Page 164).

1. The Alpine Triton (Тритон гірський), Triturus alpestris Laurenti, 1768.
2. The Carpathian Triton (Тритон карпатський), Triturus montandoni (Boulenger, 1880).
3. The Spotted Salamander (Саламандра плямиста), Salamandra salamandra Linnaeus, 1758.
4. The Running Toad (Ропуха очеретяна), Bufo calamita Laurenti, 1768.
5. The Agile Frog (Жаба прудка), Rana dalmatina Bonoparte, 1840.

B. Amphibians proposed to be additionally entered to the new edition of the Red Book of Ukraine in accordance with Law of Ukraine "On the Red Book of Ukraine" (N 3055-III of February 7, 2002) and recent research in this group of vertebrates:

6. The Danube Triton (Тритон дунайський), Triturus dobrogicus (Kiritzescu, 1903).
7. The Karelin Triton (Тритон Кареліна) Triturus karelinii (Strauch, 1870).
8. The Yellow-Bellied Toad (Джерлянка жовточерева або кумка гірська), Bombina variegata (Linnaeus, 1758).

 

It should be emphasized that Ukraine ratified several international conventions directly related to the preservation of individual species of the amphibious fauna of Ukraine. Thus, the 1979 Bern Convention (Convention on the protection of the wild fauna and flora and environment in Europe) provides for two lists of animals listed in Appendix II and III. Appendix II is a list of animals under special protection. It contains the following species of amphibians of the Ukrainian fauna:

  • The Carpathian Triton (Тритон карпатський) Triturus montandoni (Boulenger, 1880);
  • The Danube Triton (Тритон дунайський), Triturus dobrogicus (Kiritzescu, 1903);
  • The Karelin Triton (Тритон Кареліна), Triturus karelinii (Strauch, 1870);
  • The Crested Triton (Тритон гребінчастий), Triturus cristatus (Labrenti, 1768);
  • The Yellow-Bellied Toad (Джерлянка жовточерева або кумка гірська), Bombina variegata (Linnaeus, 1758);
  • The Red-Bellied Toad (Джерлянка червоночерева або кумка звичайна), Bombina bombina (Linnaeus, 1761);
  • The Spade-Footed Toad (Жаба часникова звичайна або часничниця звичайна), Pelobates fuscus (Laurenti, 1768);
  • The Running Toad (Ропуха очеретяна), Bufo calamita Laurenti, 1768;
  • The Green Toad (Ропуха зелена), Bufo viridis Laurenti, 1768;
  • The Common (or European) Tree Frog (Квакша звичайна (деревна) або краковка звичайна), Hyla arborea (Linnaeus, 1758);
  • The Moor Frog or Swedish Swamp Frog (Жаба гостроморда), Rana arvalis Nilsson, 1842;
  • The Agile Frog (Жаба прудка), Rana dalmatina Fitzinger in Bonaparte, 1839.

 

Appendix III is a list of animals under protection. It contains all other (not listed in Appendix II) amphibious species in Ukraine:

  • The Alpine Triton (Тритон гірський), Triturus alpestris Laurenti, 1768;
  • The Common Triton (Тритон звичайний), Triturus vulgaris (Linnaeus, 1758);
  • The Spotted Salamander (Саламандра плямиста), Salamandra salamandra (Linnaeus, 1758);
  • The Grey Toad (Ропуха сіра або ропуха звичайна), Bufo bufo (Linnaeus, 1758);
  • The Brown Frog (Жаба трав'яна), Rana temporaria Linnaeus, 1758;
  • The Lake Frog (Жаба озерна), Rana ridibunda Pallas, 1771;
  • The (European) Pool Frog (Жаба ставкова), Rana lessonae Camerano, 1882 "1881";
  • The Edible Frog (Жаба їстівна), Rana kl. esculenta Linnaeus, 1758.

     Thus, the list of amphibians proposed for the new edition of the Red Book of Ukraine comprises both groups of species forming both Appendix II and Appendix III of the Bern Conference on protection of the wild fauna and flora and the natural environment in Europe.
